In August 2012, the American Bar Association passed a resolution addressing the impact of Fetal Alcohol Spectrum Disorders on the criminal justice system. Among the many recommendations, the resolution states that courts should consider FASD as “a factor in mitigation with juvenile and adult offenders during sentencing, particularly where the death penalty is an option. This mitigating factor should also be applied when considering alternatives to incarceration, including therapy, community-based programs, and other non-custodial measures, in order to rehabilitate the individual and reduce recidivism.”
